WILLS SERVICES
The importance of having a valid will cannot be overstated. In South Africa, you have the freedom of testation, allowing you to determine the distribution of your assets after your death. Without a valid will, you risk dying intestate, which means your estate will be divided according to the law—often resulting in unintended consequences. A well-drafted will is, therefore, a crucial component of the estate planning process.
When creating a will, you have two main options:
Simple Will
A simple will allows you to specify how your assets will be allocated to chosen individuals. You will also appoint an executor responsible for managing the administration of your estate.
Will With A Testamentary Trust
This option is particularly relevant if you have minor children. In a will with a testamentary trust, the assets you leave for your children will be managed by trustees appointed to oversee the trust. These trustees will handle the assets for your children’s benefit, covering expenses such as education until they reach a predetermined age, at which point they can access the capital directly after the trustees distribute the assets.
Without a minor’s trust, any inheritance intended for your children may be directed to the guardian fund, where it will be administered for their benefit, potentially limiting your control over how those assets are managed.

Drafting of Last Will and Testament:
1. Simple Will: R800 per will
2. Will Including a Testamentary Trust (usually for minors): R1400 per will
The fee for drafting of Last Will and Testament includes an electronic copy of our Heritage File to help you keep all your important heritage documents together.
Heritage File
Our Heritage File is designed to help you organize and preserve your important documents. This file is a guideline to assist you with providing a secure place for:
• Legal Documents: Wills, trusts, and other essential legal papers.
• Personal Records: Birth certificates, marriage licenses, and other significant records.
• Financial Information: Bank statements, property deeds, and insurance policies.
• Important Contacts: A list of family members, executors, and advisors for easy reference.
• Other sentimental items: You may include letters to family, a list of items you have not included in your will, but deem sentimental and want specific people to have, and other wishes not relating to your estate.
With the Heritage File, you can ensure that all your vital information is easily accessible for you and your loved ones, providing peace of mind during challenging times.
This file is available in either PDF or Hard copy:
1. Electronic (PDF) Template: R350 per copy
2. Hard Copy: R400 per copy
